Affiliate Terms and Conditions

These terms and conditions of use (Terms) govern the agreement between any affiliates and users of Astalty (Affiliate) and Astalty Pty Ltd ACN 648 362 350 (Astalty).

By taking part in our affiliate program, the Affiliate acknowledges and agrees that it has had a sufficient chance to read and understand these Terms and agrees to be bound by them.

Payment

Astalty may offer incentives to Affiliates for referring new customers to Astalty. The Affiliate may be paid a commission for each new customer referred to Astalty that makes a purchase. The amount paid to the Affiliate will be determined by Astalty and may be changed at any time.

All commissions are calculated based on GST exclusive amounts and GST may be paid on top of the commission value if the Affiliate is registered for GST.

Recipient Created Tax Invoice (RCTI)

When an Affiliate is paid a commission, the Affiliate will be issued with a Recipient Created Tax Invoice (RCTI) for the commission amount if the Affliate is registered for GST. The Affiliate is responsible for ensuring that the details on the RCTI are correct and that the RCTI is retained for tax purposes. With respect to the RCTI, both Astalty and the Affiliate acknowledge;

both Astalty and the Affiliate are registered for GST
the Affiliate will not issue a tax invoice in respect of the supply of the Services
that Astalty can issue an RCTI for the supply of the Services
the Affiliate will notify Astalty if the Affiliate ceases to be registered for GST
the Affiliate will notify Astalty if the Affiliate becomes registered for GST

No direct messaging

Please refrain from directly messaging people you don't know who are looking for software with a link to your referral code.

No Self-Referrals

You cannot refer yourself to earn commissions.

Restricted Websites

No affiliation is allowed for coupon, deal, loyalty, cash-back, rewards, or virtual mall websites.

Intellectual Property and Rights

You must not infringe on Astalty Pty Ltd's or any third party’s intellectual property, publicity, privacy, or other rights.

Prohibited Practices

No cookie stuffing, altering, or the use of adware, spyware, loyaltyware, or similar software.

Link Traceability

All referral links must be verifiable/traceable. No other links will be eligible for the affiliate program.

Legal Compliance

You must not violate any laws, rules, or regulations.

Domain Restrictions

You must not purchased domains/URLs containing "Astalty" or "Astalty Pty Ltd" to forward to your affiliate URL.

Advertising Restrictions

You must not purchase ads or advertising using your affiliate URL or linking to a page promoting our affiliate program. Affiliates MAY NOT bid on Astalty Pty Ltd name, product names, or misspelled keywords for the purpose of PPC on search engines (e.g., Google, Bing).

Content Guidelines

You must not include our affiliate links or program in content that is defamatory, obscene, threatening, harassing, harmful to minors, or contains nudity, pornography, or sexually explicit materials.

No Public Forum Posts

You must not post our affiliate link in public forums, including but not limited to Facebook, LinkedIn, Instagram, Twitter, or TikTok. Affiliate links should only be used in private communications with your network contacts.

Website Presentation

Your website must not copy, resemble, or mirror the look and feel of our website. You should not create the impression that your website is our website.

Misleading Tactics Prohibited

No use of cookie stuffing, false or misleading links, or any attempt to mask the referring URL information.

The use of "Astalty" or "Astalty Pty Ltd" in domain names or social media handles is strictly prohibited.

Email Campaigns

If promoting via email, you must comply with the Spam Act 2033 and ensure emails are sent on your behalf without implying they are sent on behalf of Astalty Pty Ltd.

Any breach of the above terms and conditions may result in your eligibility for the Astalty Pty Ltd Affiliate Program being revoked and any accrued incentives being withheld or reclaimed. Astalty Pty Ltd reserves the right to take further legal action where necessary to address any violations. Astalty may terminate this Agreement immediately at any time for its sole convenience.
